These Terms of Service, together with the Privacy Policy, govern your use of the Sleep Tracker: Sleep Sounds mobile application (the "Application") and related services provided by KIRYL SADKO, operating under the trade name CodeSculptors ("Us", "We").

By downloading or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.

Consumer Rights

Nothing in these Terms limits any consumer rights that cannot be excluded or limited under applicable law. If you are a consumer, you may have additional rights in your country of residence.

Eligibility

You must be at least 13 years old to use the Application. By using the Application, you confirm that you meet this requirement.

Health Disclaimer

The Application is intended to support healthy sleep habits and provide educational information only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always seek the advice of a qualified healthcare professional before making decisions related to your health or sleep. Individual results may vary.

Intellectual Property Rights

The Application, including all content, software, trademarks, logos, and design elements, is owned by us or our licensors and is protected by applicable intellectual property laws.

Except for the rights granted to you under the applicable platform end user license agreement, no rights or licenses are granted to you in relation to the Application or its content.

Disclaimer of Warranty

The Application is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities arising out of or related to your use of the Application.

Subscriptions

The Application may offer auto-renewable subscriptions. Available plans, pricing, and billing periods are displayed in the Application and on the relevant app store before purchase.

Payments, renewals, cancellations, and refunds are processed exclusively by the platform provider (Apple App Store or Google Play) in accordance with their respective policies. We do not store your full payment information.

You may manage or cancel your subscription at any time through your platform account settings. Cancellation takes effect at the end of the current paid billing period.

Subscription pricing may vary by region and currency as determined by the platform provider.

Alarm Functionality

The Application includes alarm features intended for convenience only. We do not guarantee that alarms will function in all circumstances due to factors outside our control, including device settings, operating system restrictions, battery optimization, or hardware issues.

You should not rely solely on this Application as your only means of waking up for critical appointments or obligations. To the maximum extent permitted by applicable law, we are not liable for any damages resulting from missed alarms.

Sleep Recording

The Application may allow recording of ambient sounds during sleep sessions. By using this feature, you acknowledge that:

You are responsible for complying with applicable laws and obtaining consent from any individuals who may be recorded
Recordings are stored locally on your device and are not transmitted to our servers
You are solely responsible for the content of your recordings

License and Platform Terms

Your right to use the Application is governed by the end user license agreement of the platform from which you downloaded the Application.

If you downloaded the Application from the Apple App Store, your use is subject to Apple’s Standard End User License Agreement ("Apple EULA"). In the event of any conflict between these Terms and the Apple EULA, the Apple EULA shall prevail.

If you downloaded the Application from Google Play, your use is subject to the Google Play Terms of Service and applicable Google Play policies.

These Terms apply only to the extent that they supplement and do not conflict with the applicable platform terms.

Platform Terms

Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of laws principles. If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.

Miscellaneous

We may update these Terms from time to time. Continued use of the Application after changes take effect constitutes acceptance of the updated Terms.
